Boater Getaways is a community site for boaters, reached at boatergetaways.tv and its companion domains. These terms are the agreement between you and the operator of boatergetaways.tv (“we”). Using the site means you accept them.
Today the site is open reading plus community maintenance tips; you do not need an account. Accounts, trip posts, classifieds and messaging arrive as the community opens, and these terms cover them as they do. You must be at least 18, or the age of majority where you live, to post anything. You are responsible for what you post.
The harbor data, positions, facilities and anything members write are informational only. They can be wrong, incomplete or out of date, and they are not a substitute for official charts, publications and local notices to mariners. You may not rely on this site for navigation or passage planning. You are the skipper; every decision on the water is yours alone.
Harbor data is drawn from OpenStreetMap, a community-built map of the world, under the ODbL licence; we do not verify it. Contributions from members are their opinions and recollections, not ours.
Maintenance tips and other member content publish immediately, without review. Boater Getaways does not review, verify, edit or endorse member content before or after it appears, and it is solely the responsibility of its author. Anything you follow from a community tip you follow at your own risk. Follow your manufacturers’ manuals and consult a qualified marine mechanic or surveyor before acting on anything you read or watch here. We may remove content that is reported to us or that breaks these terms, but we have no obligation to monitor.
You keep ownership of everything you post. You give us a non-exclusive, royalty-free licence to host, display and distribute it on the site and in the places where the site shows itself off, until it is deleted. Post only what you have the right to post — your own video, your own photos, words that are yours to share.
Do not: impersonate anyone; harass other members; post content that is unlawful, infringing, unsafe by intent or deceptive; misrepresent an item you are selling; scrape or bulk-download member content; probe or disrupt the service; or use the site to follow a boat whose skipper has not chosen to share with you. We may remove content and, once accounts exist, close accounts that break these terms.
When classifieds open, Boater Getaways is a bulletin board, not a marketplace operator. We are not the seller, buyer, broker, shipper, escrow agent or guarantor of anything listed. We take no payment, hold no funds, and take no commission. Any sale is a private transaction between the members involved, on terms they agree between themselves, and any dispute belongs to them.
When trip sharing opens, sharing a boat’s position will be off by default and enabled per trip by the skipper, for the audience they choose. Do not republish another member’s position data. Position data, when shown, may be delayed or wrong and is not for any operational use.
The site is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy of information. To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, for anything a member does or posts, for any transaction between members, or for any decision — on the water, in the yard or on the road — made in reliance on the site or on member content. Where liability cannot be excluded, it is limited to the greater of $50 or what you paid us in the past year (today: nothing).
These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules, and disputes belong to the state or federal courts located in Los Angeles County, California. If part of these terms is unenforceable, the rest stands.
If we change these terms in a way that matters, we will post the new version here with a new effective date. Using the site after that means you accept the change.
